WHO is covered?

General Liability insurance is available to all NASO-ON member officials associations. General liability coverage will be provided to the NASO-ON member association, its officers, directors, and committee members while acting in the capacity of an officials association, or as an officer, director, or committee member of the association.

NASO-ON active for-profit assigning companies members, are not eligible for this coverage, unless previously purchased through American Specialty.

WHAT is covered?
General liability provides coverage for claims for bodily injury, property damage, and personal injury. Coverage extends to claims brought against the association by athletic participants (participant legal liability).

Coverage extends to typical activities of a local officials association and includes the assigning of game officials and the conducting of seminars, conferences, camps, clinics, and similar meetings designed to improve officiating knowledge and skills.

Unintentional errors and omissions coverage

NASO-ON member associations that purchase General Liability will now have coverage for unintentional errors and omissions, up to $50,000 per occurrence.

Coverage is provided for claims alleging a breach of duty as an officials association by reason of error or omission occurring while acting as an officials association or as an officer, director, or committee member of the association. This coverage does not eliminate the need for a Directors and Officers policy, but is an added benefit now included to address specific exposures of a local officials association.

WHAT are the policy limits?
The policy in which NASO-ON member associations are included provides up to a $3,000,000 per occurrence general liability limit with a policy aggregate of $4,000,000. The per occurrence limit is the most the policy will pay for all insureds for any one occurrence. The policy aggregate is the most the policy will pay for all claims that occur during the policy period.

The limit is $50,000 per occurrence for unintentional errors and omissions of the association, or its officers, directors, or committee members of the association. This limit is included, and not in addition to, the overall $3,000,000 occurrence and $4,000,000 aggregate limit stated above. The per occurrence limit is the most the policy will pay for all insureds for any one occurrence.

WHEN does coverage begin and expire?
Coverage will begin once the enrollment form and premium are received and processed by American Specialty.

NOTABLE policy exclusions include:

  • Use of non-owned and owned automobiles or buses and aircraft
  • Property of others in the care, custody and control of the insured
  • Injury to an employee
  • Liquor liability
  • Medical malpractice
  • Employment related practices
  • War

No coverage is extended and no representations are made except by the policy. All claims will be evaluated on their own merit and all coverage issues will be determined by reference to the terms and conditions of the policy as issued.

General Liability Q&A


Q:
Is premium adjusted for change in membership?
A: Premium is based on membership at the time of enrollment. Accurate membership figures should be provided at the time of enrollment. American Specialty reserves the right to audit membership numbers at any time.

Q: What should a NASO-ON member local officials association do if it thinks it has a claim or a potential claim?
A: An association leader should contact American Specialty at 800-245-2744 as soon as possible. In the event a lawsuit is filed, suit papers and other documentation should be sent to American Specialty by priority mail.

Q: Does this policy provide General Liability coverage for individual officials while officiating?
A: No, but officials who are members of the National Association of Sports Officials (NASO) are provided with General Liability coverage.

General Liability Enrollment Procedures:

1) General Liability insurance is only available and exclusive to NASO-ON member associations. Make sure your association is active with NASO-ON by calling 262-632-5448.

2) Complete the Member Association General Liability Enrollment Form for the General Liability coverage.

3) Return the General Liability enrollment form along with a check payable to American Specialty Insurance & Risk Services, Inc. Coverage will not begin until the application and check are received by American Specialty.

A certificate of insurance will be returned to the contact person at your officials association evidencing General Liability insurance. If additional-insured certificates are required during the year, please contact American Specialty at 800-245-2744.

DIRECTORS AND OFFICERS COVERAGE SUMMARY

Directors and Officers Q&A

NASO-ON offers an optional Directors and Officers insurance program for not-for-profit local officials associations. For-profit organizations are ineligible for the Directors and Officers (D&O) coverage.

D&O insurance will cover the local officials association, its directors and officers, committee members and employees for wrongful acts. Wrongful acts include actual or alleged errors or misstatements, omissions, negligent acts, misleading statements, or breach of duty committed by an insured in the performance of his or her duties on behalf of the insured officials association. For updated coverage limits please contact American Specialty.

Please note that D&O coverage is not purchased simply by completing the application. A proposal must be accepted first by the association.

Directors and Officers Q&A

Q:
If I want to purchase D&O coverage, what do I do?
A: The association must complete the application and send it along with by-laws, financial information, and a list of the board of directors to American Specialty. Once information is received, a proposal will be returned to your association for review. If your association wishes to bind coverage, written documentation must be sent to American Specialty along with the original, signed application. Coverage will be effective the date American Specialty receives the order to bind.

Q:
Why would a local officials association need D&O insurance?
A: Many directors and officers assume that because they have General Liability insurance, all of their exposures to loss are covered. This is not true. Directors and officers face risks that would not be covered by a General Liability policy. By purchasing D&O insurance, you can protect yourself against certain added exposures you have as a board member or committee member that is making decisions on behalf of the association.

Game Fee Reimbursement Excess Accident Medical

In spite of our best efforts to prevent them, accidents –
serious ones – can and do happen every day. If a serious
accident occurs, the primary concern should be recovering
from the injury…not the financial loss such an accident
can create.

That’s why NASO-ON is offering an insurance plan for
members of your association that can help provide them
with financial peace of mind against the risk of covered
injuries.

ELIGIBILITY
All enrolled member officials of NASO-ON associations
who are assigned or would have been assigned (with proof
of proper documentation) to officiate at a regularly
scheduled activity and for which premium has been paid
under the policy.

COVERAGE
Coverage is provided while the member official is
engaging in officiating activities (which include assigning,
chain crew, attending or operating officiating camps,
clinics or meetings) during regularly scheduled sports or
activities competition. Coverage is provided during
officiating activities while traveling as part of a group in
transportation furnished or arranged by the Policyholder.
Coverage is also provided while traveling directly to or
from the Insured’s home premises and the site of such
activities.

BENEFITS
Game Fee Indemnity Benefit-When covered Injuries
result in Total Disability beginning within 90 days after the
date of the accident, we will pay benefits at the rate of
$50.00 per scheduled game missed subject to a maximum
amount of $500.00 per week. Benefits are payable for
scheduled games missed for 52 weeks from the date of the
accident or when the maximum benefit amount of $2,000
per official per calendar year has been paid, whichever
occurs first. Benefits begin on the date of the first Medical
Treatment during Total Disability, subject to the 14 day
Deductible Period.

Accident Medical Expense - When a covered injury to an
Insured results in treatment by a physician or surgeon
within 30 days of the accident, We will pay up to a
maximum benefit of $25,000 per occurrence after the
$1,000 deductible amount has been met (eligible medical
expenses payable under any other insurance policy or
service contract will be used to satisfy or reduce the
accident medical deductible). There is a $1,000 maximum
benefit amount for: Dental expenses (for injuries to sound
natural teeth), Outpatient Physical Therapy and Orthopedic
Appliances expenses.

Eligible expenses are: (a) treatment by a physician or
surgeon; (b) care or services from a hospital; (c) services
from a registered graduate nurse (RN or LPN), not related
to the Insured by blood or marriage; (d) professional
ambulance service; (e) orthopedic appliances; (f) services
of a physical therapist when acting under the direction of a
Legally Qualified Physician or on prescription of a Legally
Qualified Physician; or (g) prescription drugs. Durable
Medical Equipment expenses are not covered.
Only eligible medical expenses incurred by the Insured
within 52 weeks from the date of the accident are covered.
Benefits for any one accident shall not exceed in the
aggregate the maximum Medical Benefit. Benefits will be
paid only for expenses that are not recoverable from any
other insurance policy, service contract or workers’
compensation. Failure by an Insured to follow the terms
and conditions of his or her primary coverage will result in
a benefit reduction of eligible expense to 50% of the
amount otherwise payable.

DEFINITIONS
“Deductible Period” relative to weekly disability benefits
means that period of total loss of time during which, in
consideration of the issuance of the coverage for the
applicable premium, loss of time benefits are not payable.
Such period shall begin on the first date of medical
treatment during such loss of time.

"Hospital" means any of the following places: (a) a place
which is licensed or recognized as a general hospital by the
proper authority of the state in which it is located; (b) a
place operated for the care and treatment of resident
inpatients with a registered graduate nurse (RN) always on
duty and with a laboratory and X-ray facility; (c) a place
recognized as a general hospital by the Joint Commission
on the Accreditation of Hospitals; or (d) a place certified
as a hospital by Medicare. Not included is a hospital or
institution or a part of such hospital or institution which is
licensed or used principally: (1) for the treatment or care
of drug addicts or alcoholics; or (2) as a clinic, continued
or extended care facility, skilled nursing facility,
convalescent home, rest home, nursing home or home for
the aged.

"Injuries" means accidental bodily injuries: (a) received
while insured under this policy; and (b) resulting,
independently of sickness and all other causes,
“Total Disability” means that period of time during which
you: (a) receive medical treatment and (b) are completely
unable to engage in your occupation. Occupation for the
purposes of this coverage refers to officiating in the same
sport that the insured was officiating at the time of the
accident.

EXCLUSIONS
This program does not cover: (a) suicide, attempted
suicide or intentionally self-inflicted injury while sane or
insane (in Missouri, while sane only); (b) injuries caused
by an act of declared or undeclared war; (c) injuries
received while in the armed service (upon notice to us of
entry into an armed service, the pro rata premium will be
refunded); (d) injuries received while acting as a pilot or
crew member; (e) injuries resulting from air travel, except
while a passenger for transportation only; (f) injuries
resulting from the Insured’s engagement in or attempt to
commit a felony or being engaged in an illegal occupation;
(g) injuries received while under the influence of any
controlled substance, unless administered on the advice of
a physician; (h) injuries received while intoxicated, except
as defined in the policy; (i) injuries sustained while
traveling other than as specifically state in the policy; (j)
the cost of eyeglasses, contact lenses or examinations for
either; (k) the cost of dental treatment, except as
specifically provided for injuries to sound, natural teeth; (l)
injuries covered by workers' compensation
